When editing on different mod objects (without leaving edit mode) with the texture picker open, the texture picker will scroll to and highlight the texture if you have it in your inventory.
Since CHUI, if you are in edit mode on one prim that you have the texture for in inventory and then click on another prim (or face) that you do not have the texture for in inventory, the texture picker highlights the texture from the last prim (or face) selected.
Rez a cube A and add any texture A to it that you have in your inventory.
Rez a cube B and leave it as the default plywood texture (or use any other texture B from inventory and then delete texture B and purge trash).
Right click & Edit on cube A -> Go to texture tab -> Open texture picker - observe texture picker scrolls to and highlights texture A.
Without leaving edit mode, now left click on cube B and observe what you see in the texture picker.
Observed Behaviour
On CHUI builds, texture A will still show highlighted in texture picker indicating wrongly that the texture applied to cube B is texture A.
On Pre-CHUI builds, no texture will be highlighted in texture picker - this is the correct behaviour.
Expected Behaviour
No texture should be highlighted in the texture picker because texture B is not in your inventory.

Steps To Reproduce
Compare behaviour on a recent viewer build and a pre-CHUI viewer build.
For a pre-CHUI build you can use: http://wiki.secondlife.com/wiki/Release_Notes/Second_Life_Release/3.2.8
