With the growth of secondlife, texture theft is becoming more and more of a problem. Textures of several major brand skins have beeing stolen, and the skins are beeing resold full permission, making them turn into freebies in no time.
Several Naughty Designs skins, X2 skins and some other major skin brands have already been the victim of this, making their items lose value when they spread. Most popular stores items already have been ripped and are sold in many stores. (I wont name the stores here to protect the creators but the lindens can contact me to get a list.. if they ever will reply to this issue)
Although the DMCA can be used to stop stolen textures from beeing sold or given away, its hardly possible to stop them before they already have spread to hundreds of inventories of residents that may start selling/giving away that same item themselves (and not even know it's stolen).
It's very hard for the creators of popular items to on the long term to stop them from spreading through secondlife. On the longer term the DMCA alone has not enough impact.
There are stolen copies out there of almost every big brand now
Any help on this issue will be welcome.
List of ideas:
- When a succesfull DMCA is filed for a stolen item (in cases where the stolen item has a different UUID from the original, ripped by an outside program and reuploaded), get the UUIDs of the textures used and delete these textures from the asset server, so all spread copies won't work anymore (and will show "texture missing", or could be replaced with a "stolen item" texture) This will limit the wide spread of stolen items. Why isn't this done?
- Give creators of textures when uploading the option to only allow objects which list them as the creator use the textures. This would prevent the copying of UUIDs.

- There should be some kind of database for people who like to register their textures as theirs, so in case they get stolen they don't have to file a single DMCA for every thief. Sueing people with a DMCA is risky, since the rippers can get their private info when they counterfile. When you are the creator of a skin it's not hard to prove you created it, since skins are made in many stepts that rippers can't reproduce. That way will make it easier to get rid of thieves and resellers.
- Items which are stolen could be deleted from the inventory of those that resell them in their shops and are filed with a DMCA or be made no transfer so they can't put them back in their shops anymore. Now rippers can just put back the items in another shop around the corner and keep selling them or send them to an alt. (after all, most people reselling stolen items are not the rippers themselves, so they don't have the textures on their harddrive. most of them are (full permission) resellers or newbies in malls.)
- People who have uploaded stolen textures should be banned from SL completely. In several cases the ripper had payment info on file, so they know who it is. This person should not be allowed back.
- Suggestion by Mallory Cowen:
"Banning thieves is useless as they just keep coming back with new alt accounts, there are even ways around IP/hardware bans. We need to bring back the system where everyone have to verify their identity when joining Second Life, for example by providing their credit card number. If someone breaks the ToS, they get banned by their credit card. As long as it's easy to create new accounts, it will always be easy to sell stolen items."
After all the wide spreading of stolen items is a huge problem, maybe even more than the ripping itself. The ripper may be the one that caused the problem, but the resellers that are spreading items for bottom prices and should be stopped too, because they hurt the original creators the most. They hurt other shops too, because who can compete with secondlife most popular items beeing sold for just 5$? Also, it would save the lindens a lot of time, not having to go through hundreds DMCAs for copies of the same rip.
On the long term, a way to make it harder to rip the textures themselves could be invented too, because now even totally unskilled people rip textures easily. Although its impossible to make this 100% failproof, the amount of people that could rip would be much smaller, and the amount of stolen items would be much less if only skilled people could steal them and not everyone.
Even though making ripping 100% failproof isn't possible, why not try and limit the damage it does and stop the spreading as much as possible?
The DMCA and current methods are failing MISERABLY, ANY improvement on the system of stolen items would be welcome, suggestions and ideas are very welcome too.
What use is it to say people have copyright of their items when nothing is done to prevent stealing or spreading?

- You may have heard us talk about "first use metadata", that is a time stamp that is attached to your creations, including uploaded textures, that shows first use. First use is an important part of being able to claim copyright ownership. This work is started, and we are committed to completing it quickly.
- We could work to reduce how much avatar/clothing data is downloaded, so that a copy can be made of the baked texture and shape but not the pieces. We're interested in your thoughts on that option.
- We can reduce incentives to copying content within the system, by preserving the creator attribution such as with creative commons licensing.
- We could create hover text which would act like a garment label does, exposing both the first use metadata and also a brand name, reducing the incentive to copy by making it obvious that copying is occurring. If your work is "signed", and clearly you developed it first, then the person who purchases the copy is not unlike the person who buys the fake Rolex off the back of a truck. Plus the signature becomes a recognizable asset and could be coupled with a landmark as a form of advertising.

For example, change the sequence of the pixels. Because the deforming is done after uploading it will not create any extra lag in game, it's just wrapped around the avatar differently so only will be done once when uploaded. This could be implemented possibly only for new textures, or as a new option to select when creating new skin/clothes etc.
The last suggestion is probably the most effective, although off course it can be cracked by a skilled person, it will make it a lot harder to do so because it can't be done anymore with a program that is easily found on the internet.

With the growth of secondlife, texture theft is becoming more and more of a problem. Textures of several major brand skins have beeing stolen, and the skins are beeing resold full permission, making them turn into freebies in no time.
Several Naughty Designs skins, X2 skins and some other major skin brands have already been the victim of this, making their items lose value when they spread. Its just a matter of time of time till this will happen to more popular skins, clothes, tattoos and any texture based items.
Although the DMCA can be used to stop stolen textures from beeing sold or given away, its hardly possible to stop them before they already have spread to hundreds of inventories of residents that may start selling/giving away that same item themselves (and not even know it's stolen).
It's very hard for the creators of popular items to on the long term to stop them from spreading through secondlife. On the longer term the DMCA alone has not enough impact.
These are just some suggestions, to try to do something about this problem. I am no technician/ programmer, but any improvement would be welcome (so suggestions are very welcome too)

Almost 2 years ago linden lab was working on this, and thinking about other options for this problem (read full post). I would like to know if there has been progress in this?

Banning thieves is useless as they just keep coming back with new alt accounts, there are even ways around IP/hardware bans. We need to bring back the system where everyone have to verify their identity when joining Second Life, for example by providing their credit card number. If someone breaks the ToS, they get banned by their credit card. As long as it's easy to create new accounts, it will always be easy to sell stolen items.

* People who have uploaded stolen textures should be banned from SL completele. In several cases the ripper had payment info on file, so they know who it is. In some cases the ripper made an alt and continued selling stolen items. Why aren't these people banned permanently?
* There should be some kind of database for people who like to register their textures as theirs, so in case they get stolen they don't have to file a single DMCA for every thief. Sueing people with a DMCA is risky, since the rippers can get their private info when they counterfile. When you are the creator of a skin it's not hard to prove you created it, since skins are made in many stepts that rippers can't reproduce. That way will make it easier to get rid of thieves and resellers.

When a DMCA is filed for a stolen item, get the UUIDs of the textures used and delete these textures from the asset server, so all spread copies won't work anymore (and will show "texture missing", or could be replaced with a "stolen item" texture) This will limit the wide spread of stolen items. Banning thieves is useless as they just keep coming back with new alt accounts, there are even ways around IP/hardware bans. We need to bring back the system where everyone have to verify their identity when joining Second Life, for example by providing their credit card number. If someone breaks the ToS, they get banned by their credit card. As long as it's easy to create new accounts, it will always be easy to sell stolen items.
After all the wide spreading of stolen items is a huge problem, maybe even more than the ripping itself. The ripper may be the one that caused the problem, but the resellers that are spreading items for bottom prices and should be stopped too, because they hurt the original creators the most. They hurt other shops too, because who can compete with secondlife most popular items beeing sold for just 5$? Even though making ripping 100% failproof isn't possible, why not try and limit the damage it does and stop the spreading as much as possible?

Up till now no single linden has taken the effort to post even a single reply to this post, why aren't creators taken seriously on tjis issue? What use is it to say people have copyright of their items when nothing is done to prevent stealing or spreading? Why don't we even get a single reply?

* There should be some kind of database for people who like to register their textures as theirs, so in case they get stolen they don't have to file a single DMCA for every thief. Sueing people with a DMCA is risky, since the rippers can get their private info when they counterfile. When you are the creator of a skin it's not hard to prove you created it, since skins are made in many stepts that rippers can't reproduce. That way will make it easier to get rid of thieves and resellers.

* You may have heard us talk about "first use metadata", that is a time stamp that is attached to your creations, including uploaded textures, that shows first use. First use is an important part of being able to claim copyright ownership. This work is started, and we are committed to completing it quickly.
* We could work to reduce how much avatar/clothing data is downloaded, so that a copy can be made of the baked texture and shape but not the pieces. We're interested in your thoughts on that option.
* We can reduce incentives to copying content within the system, by preserving the creator attribution such as with creative commons licensing.
* We could create hover text which would act like a garment label does, exposing both the first use metadata and also a brand name, reducing the incentive to copy by making it obvious that copying is occurring. If your work is "signed", and clearly you developed it first, then the person who purchases the copy is not unlike the person who buys the fake Rolex off the back of a truck. Plus the signature becomes a recognizable asset and could be coupled with a landmark as a form of advertising.

List of ideas:
* Give creators of textures when uploading the option to only allow objects which list them as the creator use the textures. This would prevent the copying of UUIDs.

With the growth of secondlife, texture theft is becoming more and more of a problem. Textures of several major brand skins have beeing stolen, and the skins are beeing resold full permission, making them turn into freebies in no time.
Several Naughty Designs skins, X2 skins and some other major skin brands have already been the victim of this, making their items lose value when they spread. Most popular stores items already have been ripped and are sold in many stores. (I wont name the stores here to protect the creators but the lindens can contact me to get a list.. if they ever will reply to this issue)
Although the DMCA can be used to stop stolen textures from beeing sold or given away, its hardly possible to stop them before they already have spread to hundreds of inventories of residents that may start selling/giving away that same item themselves (and not even know it's stolen).
It's very hard for the creators of popular items to on the long term to stop them from spreading through secondlife. On the longer term the DMCA alone has not enough impact.

Almost 2 years ago linden lab was working on this, and thinking about other options for this problem (read full post). I would like to know if there has been progress in this?

(november 2006) has many ideas from the Lindens themselves. Why weren't they implemented? What was the reason for it?
* You may have heard us talk about "first use metadata", that is a time stamp that is attached to your creations, including uploaded textures, that shows first use. First use is an important part of being able to claim copyright ownership. This work is started, and we are committed to completing it quickly.
* We could work to reduce how much avatar/clothing data is downloaded, so that a copy can be made of the baked texture and shape but not the pieces. We're interested in your thoughts on that option.
* We can reduce incentives to copying content within the system, by preserving the creator attribution such as with creative commons licensing.
* We could create hover text which would act like a garment label does, exposing both the first use metadata and also a brand name, reducing the incentive to copy by making it obvious that copying is occurring. If your work is "signed", and clearly you developed it first, then the person who purchases the copy is not unlike the person who buys the fake Rolex off the back of a truck. Plus the signature becomes a recognizable asset and could be coupled with a landmark as a form of advertising.

[ Abuse Reported
Took inspect shots showing creation time by the user not the bot.
Took intercept showing those copies with our digital markers which are registered to a RL company and with registrant copyright information.
Compiled full logs showing the grab, recreation and correlation with the inspect shot
Cross referenced the logs showing those and then to the work copied from us, and back matched to the copyright information held off platform.
I contacted Harry Linden twice with no response, and then Michael Linden asking for an explanation as to why Linden Lab declined to ban this user. e.g. do they want more data, proof? I am happy to provide as much as needed. I contacted Glenn Linden initially as I am on SLDEV to ask how to submit the extra data and sent it to the email address he provided.
Michael Linden responded yesterday and referred me back to Harry so I have contacted him today. I have asked for an explanation by close of week.
My frustration is not the copybot - we deal with this on a daily basis and have practices in place to manage the situation. The frustration is Linden Lab TOS with the *may* ban and when you read the above, no response. E.G ask us for more data, give us updates on our ARs.

[ A follow on up the above.
After posting this our sims had full copybot rips. The one where one avatar control the bot / viewer so two accounts running.
I had (a) full logs (b) creation logs linked to copybot lifts (c) my own (within TOS) lifts of the copy showing our digital copyright notifications (d) proof of design registration.
I have invited Michael Linden to comment as to why no banning/hardware level as occurred and whether they needed more data.
Our next step is we will post the full logs, including the intercept data to a third party website to invite people to view on a closed forum as a learning experience. So regardless if we find a route to register inworld work, there still looks like a there is apathy to remove users who actively breach IP rights.

[ All,
I have read this and the multiple other similar ones opened. Recently Blue Linden, in his office hours canvassed for ideas around how we can work on this issue. So I think you will see there is some movement underway. I'll refrain from making comment on whether I think the right solutions would be possible. I focused on these below, some may work, some will not. If anybody wants the full transcripts please contact me directly.
(1) Free Accounts. Do not restict the ability to sell / make objects. However, make it part of your Know your Customer policy that to transfer that money in world / exit the funds from SL they have to complete RL verificaton with a valid credit card (or PayPal or bankers verification) on file that matches the usual merchant check level (e.g. name matches/address matches to where card is registered). This keeps your metrics on target, keeps the new user rates up - but provides platform protection to some degree. In addition, restrict transfer ability. If you are a true free account and you want to move forward you'll sign up your RL data (we are not talking paying tier here - if you sell on Ebay you pay, if you use Paypal you are validated through certain levels dependent on activity). An interesting element is with 55% of the userbase now outside of the US - it might be worth referring your legal team to The Money Laundering Regulations 2003 in the UK as an example. We are subject to it as UK users and if over x period of time I exited more than 15K in EUR from Second Life. However international law reflected in PayPal in the UK lowers that limit to GBP 1700 in one year. Quotes below, not a legal opinion and I am sure LL will have already had advice on what applies to them and how in the UK.
Now for the main this is focused at Financial Institutions. However, PayPal is not a bank and is subject to it. So LL with their Lindex / exit to USD facility etc perhaps may have looked at this when they started charging VAT.
(2) This regulation applies if -
(a) A and B form, or agree to form, a business relationship;
(b) in respect of any one-off transaction -
(i) A knows or suspects that the transaction involves money laundering; or
(ii) payment of 15,000 euro or more is to be made by or to B; or
(c) in respect of two or more one-off transactions, it appears to A (whether at the outset or subsequently) that the transactions are linked and involve, in total, the payment of 15,000 euro or more by or to B.
(3) A must maintain identification procedures which -
(a) require that as soon as is reasonably practicable after contact is first made between A and B -
(i) B must produce satisfactory evidence of his identity; or
(ii) such measures specified in the procedures must be taken in order to produce satisfactory evidence of B's identity;
I am not clear how Linden Lab are working with the local laws of each country with a userbase. As I pay VAT UK law I suspect comes into play. Anyway food for thought.
(2) Verification / Registration. Registration if it can be done at Meta level (texture/object/script/sculpt) gives a verification code. Investment and development into the platform changes the sale / set to buy / etc function to only allow items with a verification code to be sold. Linden Lab should not have to police copyright & IP rights only act where instructed by a legal output. The content creators at the meeting in part agreed they would be prepared to pay tax on goods sold e.g. ensuring new creators could still work here, and based on your outgoing products. This would be investment into the registration system by the creators in conjunction with Linden Lab. Again think Ebay selling fees. It was further commented that most creators already pay tier on sims, so wasn't this double charging so more ideas are needed on investment and whether LL should be charging us to protect us. A SLDEV commented that they content brought user and revenue to the platform so we should not pay,
So if you change your TOS to say that it 's first come first served registration and if somebody duplicates a verification - ( added - but there is existing content to backload of course which needs more thinking about) you simply have to remove the "later" copies and robustness of such a tool). The recource where somebody registers something they do not own the IP right to - means the rightful owner files a DMCA. That leaves the WHOLE DMCA process to RL brands who are infringed or real IP owners who are infringed. Reducing down the level of random/illformed and frankly where they don't own the IP rights claims. It becomes a simple TOS management clause without any legal bearing on Linden Labs to resolve IP issues outside DMCA. It also provides immediate relief to creators and brings back viablity to the platform. You remove the policing aspect as a result.
From SLDEV dicussions it has been flagged this may be expensive / but transparancy is a must and if we can at minimum get costings / impacts out (perhaps first in SLDEV for discussion) then an action plan formed LL will show commitment, and bring back the sadly lacking integrity the platform displays externally.
(3) Market Standards / Competitors - I do recommend looking at how Sun Microsystems are moving foward with Darkstar etc. Rather than us trying to resolve in one platform we can set the standard in SL. It holds economic value to LL to achieve this.
