The implemetation of MISC-961 would seeing original creator easy, everything is tracked. In additional some kind of process investigations has to be done, as with all other abuse reports. When in come to who upploaded what texture when or linked what item at what moment it woud be trivial for LL to keep track up. I think they already have that in there databases.
Harleen has a good point. The DMCA process was designed to be exactly this... an easy to use process to get infringing stuff taken down quickly.
1. Filing a bogus DMCA report carries heavy penalties, such an in-world process couldn't carry very heavy penalties compared to filing a false DMCA. 2. The DMCA allows filing and rebuttal to happen without the provider judging whether the content is infringing or not. This is very good since the provider doesn't have to get involved. 3. The third thing the DMCA does that a process like this can't do, is if there is a filing and a rebuttal, the provider is forced to give the contact information of each party to the other party so that a lawsuit may go forward. Linden Lab's privacy policy would prevent this from happening in an internal process. So what you are asking for is exactly what the DMCA provides. I'm not sure what you mean by expense. You just have to fill out a form correctly. It's not that hard. Maybe the idea behind it was to make it easy and cheap but it isn't entering into a legal actions in a foreign country is not an easy to use process, as LL states on the DMCA page "We recommend contacting an attorney if you are unsure whether an in-world object is protected by copyright laws." Now look at the most expensive stuff i sell 950 lindens, give a second thought how much a lawer in California will cost me in RL, count how many instance i need to sell to be even close to getting this initial cost back.
The current process also needs me to give out my RL identity in public, for me that just ain't worth the items. I don't think i can get close to making that kind of money in SL that the idea of trying a DMCA legal process. I can with out possibility to evaluate any of the proof put me in a positions where I need to get an US laywer, and maybe travel to the US to defend my self (not to have to pay someone else legal fee's). I would say there is some good reason that so few DMCA cases get files and so much stuff is copied, most creators in SL are in my situation. If the case if cut close, it would be easy for LL after hearing both parties to make a decision. If it isn't, they should not rule and if I then think it's worth the risk I might get into a DMCA process. Putting $1000 at risk for a low volume $3.75, item well probably more that $1000 at risk, is not worth it, and why so much higher demands on this obvious crime than normal griefing? Don't that give the impression that LL think copyright breaches are less dangerous than running nakkied at newbie island? Nadine, the DMCA process does not cost anything. The only possible way it could cost you money is if you file a false DMCA claim and the other party decides to sue you over it.
